Made to measure and right of withdrawal

Stick & Fit is produced specially according to the sizes, fabric, colour and profile choices you specify. A correctly delivered made-to-measure product therefore falls under the made-to-measure exception and cannot be returned without a reason.

Why is this made to measure?

• Width and height to the millimetre.
• Personal fabric, colour and profile choices.
• Production specifically for your window.

What still applies?

Statutory rights continue to apply if the product has been made incorrectly, is delivered damaged or does not conform to the contract.

Check sizes, colours, quantities, references and address details. These are recorded in the order confirmation.

What is the exclusion based on?

For an online purchase, a statutory cooling-off period of fourteen days normally applies. The law makes an exception to this for goods that are manufactured to the consumer's specifications, are not prefabricated and are made on the basis of an individual choice or decision of the consumer. This exception is set out in Article 6:230p, under f, part 1, of Book 6 of the Dutch Civil Code (Burgerlijk Wetboek).

Stick & Fit falls under that exception because, for each order, the width and height to the millimetre, the fabric, the colour, the version and the two profile colours, among other things, are specified. The product is then produced specially for that one window.

What this means for you

• A correctly delivered made-to-measure product cannot be returned without a reason.
• The order is not a standard stock product with a fourteen-day cooling-off period.
• Check sizes, choices and address details carefully before you place the order.
• As long as production has not yet started, we are happy to consider a change. This is a service and not a statutory right of withdrawal.

Your statutory rights in the event of an error or defect remain in place

The made-to-measure exception does not mean that you lose your rights if the product does not match the order, has been produced incorrectly or has a defect. In that case, your statutory rights to a sound product apply. We will first be given the opportunity to assess and resolve the problem, for example by adjustment, repair or replacement.

This explanation forms part of the terms and conditions. In case of any difference, mandatory consumer law always takes precedence.
